of <h1>Section 458A of Companies Act: Exclude Winding Up Period and Extra Year from Limitation in Company Suits.</h1> Section 458A of the Companies Act, 1956, provides that in computing the limitation period for any suit or application on behalf of a company undergoing winding up by the Tribunal, the period from the commencement of winding up to the issuance of the winding up order, as well as an additional year following the order, shall be excluded. This provision overrides the Indian Limitation Act, 1908, and any other prevailing law.
