Appellate Tribunal members can resign with notice but must stay until a successor is appointed or term ends.
The Chairperson or a Member of the Appellate Tribunal under the Companies Act, 1956, may resign by submitting a written notice to the Central Government. However, they must continue in their role until the earliest of the following: three months from the notice receipt, the appointment of a successor, or the end of their term, unless the Central Government allows an earlier departure. This provision was introduced by the Companies (Second Amendment) Act, 2002, effective from April 1, 2003.
