Section 436 Discusses High Court's Power to Withdraw or Transfer Winding-Up Cases for Efficiency
Section 436 of the Companies Act, 1956, addresses the withdrawal and transfer of winding-up proceedings between courts. If a winding-up case is ongoing in a District Court, the High Court has the authority to determine if the proceedings would be more efficiently conducted in the High Court or another District Court. The High Court may either withdraw the case to handle it directly or transfer it to another District Court, where the winding-up will continue. This provision was omitted by the Companies (Second Amendment) Act, 2002, pending a notification date.
