Stay of proceedings extends to contributories during winding-up petition when sought by a creditor under company law protections. Where a petition for winding up of an unregistered company has been presented and before a winding up order is made, the statutory provisions on staying and restraining suits apply, and where the application to stay or restrain is made by a creditor these provisions extend to suits and legal proceedings against any contributory of the company.
