Section 155 of Companies Act 1956: Rectification of Member Registers Removed by 1988 Amendment Act
Section 155 of the Companies Act, 1956, previously empowered courts to rectify the register of members if a person's name was wrongly included or omitted without sufficient cause. Affected individuals, company members, or the company itself could apply for rectification. The court could reject the application or order rectification and potentially award damages. It could also address questions about membership titles and other necessary issues. Appeals from court orders could be made to higher courts based on specific grounds. These provisions also applied to the register of debenture holders. This section was omitted by the Companies (Amendment) Act, 1988.
