Company Names Under Section 20: Must Not Resemble Existing Firms or Trademarks to Avoid Being Deemed Undesirable
Under Section 20 of the Companies Act, 1956, a company cannot be registered with a name deemed undesirable by the Central Government. A name is considered undesirable if it is identical to or closely resembles the name of an existing company or a registered trademark, or one pending registration under the Trade Marks Act, 1999. The Central Government may consult the Registrar of Trade Marks before declaring a name undesirable. This provision ensures that company names do not infringe on existing trademarks or cause confusion with existing company names.
