Companies Act Section 53: Guidelines for Document Delivery to Members via Post, Personal Delivery, or Newspaper Notices.
Section 53 of the Companies Act, 1956, outlines the methods by which a company can serve documents to its members. Documents can be delivered personally or sent by post to the member's registered address in India. If a member requests, documents must be sent via registered post with acknowledgment, provided the member covers the cost. Service is deemed effective 48 hours after posting for meeting notices, or upon ordinary delivery for other documents. For members without an Indian address, documents advertised in local newspapers are considered served. Joint shareholders receive documents via the first named holder, and representatives of deceased or insolvent members receive documents at their provided address.
