<h1>New Law Caps Undertrial Detention at Half the Sentence; Exceptions for Serious Crimes Under Section 479, 2023</h1> Under Section 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023, an undertrial prisoner can be detained for a maximum of one-half of the specified imprisonment period for an offense, unless it involves death or life imprisonment. First-time offenders may be released after serving one-third of the maximum period. The court may extend detention beyond one-half of the period after hearing the Public Prosecutor. No detention can exceed the maximum imprisonment period for the offense. Delays caused by the accused are excluded from detention calculations. Multiple pending cases prevent bail release, and jail authorities must notify the court when detention thresholds are reached.
