<h1>Section 339: Conditions for Conducting Prosecution During Inquiry or Trial; Restrictions on Police Officers' Involvement</h1> Section 339 of the Bharatiya Nagarik Suraksha Sanhita, 2023, outlines the conditions under which a prosecution may be conducted during an inquiry or trial. A Magistrate may allow any person, except a police officer below the rank of inspector, to conduct the prosecution. However, permission is mandatory unless the individual is the Advocate-General, Government Advocate, Public Prosecutor, or Assistant Public Prosecutor. Additionally, police officers involved in the investigation of the offense cannot conduct the prosecution. The prosecution can be carried out personally or through an advocate.
