Section 408 - Power to direct further inquiry to be made or additional evidence to be taken

Power to order further inquiry allows High Court to direct or take additional evidence in death sentence confirmation.

High Court may, on submission of death sentence confirmation proceedings, make or direct further inquiry or take additional evidence on points bearing on guilt or innocence, either itself or through the Court of Session; the convicted person's presence may be dispensed with unless the High Court orders otherwise, and results taken by the Court of Session must be certified to the High Court.
