of <h1>High Court can order further inquiry or evidence in death sentence cases under Section 408, Bharatiya Nagarik Suraksha Sanhita.</h1> Section 408 of the Bharatiya Nagarik Suraksha Sanhita, 2023, grants the High Court the authority to order further inquiry or additional evidence in cases involving death sentences. The High Court may conduct this inquiry or evidence gathering itself or delegate it to the Court of Session. The presence of the convicted person may be waived unless the High Court specifies otherwise. If the inquiry or evidence is conducted by the Court of Session, the findings must be certified and submitted to the High Court.
