<h1>Court-martial jurisdiction: Magistrates must deliver persons liable for military trial to commanding officers, subject to rules.</h1> The Central Government may make rules, consistent with the Sanhita and existing armed forces Acts, prescribing when persons subject to armed forces law shall be tried by a Court-martial or by a civilian Court; a Magistrate charged with an offence liable to military trial must consider those rules and, when appropriate, deliver the accused and a statement of the offence to the commanding officer of the unit or nearest armed forces station for trial by a Court-martial. Magistrates must also, on written application by a commanding officer, use utmost endeavours to apprehend and secure accused persons, and a High Court may order a prisoner to be produced before a Court-martial.
