Section 163 Empowers Magistrates to Issue Urgent Orders Preventing Public Nuisance or Danger for Up to Eight Months
Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, empowers District Magistrates, Sub-divisional Magistrates, or other Executive Magistrates, as authorized by the State Government, to issue urgent orders to prevent nuisance or danger. These orders can direct individuals or groups to refrain from certain actions or manage property to prevent obstruction, annoyance, or danger to public safety. Orders can be issued ex parte in emergencies and are initially valid for up to two months, extendable by the State Government for up to six additional months. Magistrates and the State Government can rescind or alter orders, providing an opportunity for affected individuals to contest them.
