Urgent nuisance orders allow magistrates to direct preventive or remedial measures, including ex parte directions and limited duration.
In urgent nuisance or danger situations, an empowered Magistrate may issue written orders, including ex parte directions, requiring persons to abstain from acts or take measures regarding property to prevent obstruction, injury, danger to life, health or safety, disturbance of public tranquillity, riot or affray. Orders may target individuals, residents, or the public, and expire after two months unless the State Government notifies a limited extension; rescission or alteration is available to Magistrates and the State, and applicants must be afforded an early opportunity to show cause with written reasons recorded if rejected.
