Power to proceed against persons appearing guilty: court may commence fresh proceedings and arrest, summon, or detain them. Court may proceed against a person who, though not the original accused, appears from evidence to have committed an offence triable with the accused; the person may be arrested or summoned if absent, or detained if present. Proceedings against that person must be commenced afresh and witnesses re-heard, and thereafter the case may proceed as if that person had been an accused when the court took cognizance.
