<h1>Forwarding accused to magistrate: police must send accused or take security when evidence is sufficient.</h1> Section 190 requires that when investigation shows sufficient evidence, the officer in charge must forward the accused in custody to a Magistrate empowered to take cognizance or, where the offence is bailable and security is forthcoming, take security for appearance and attendance; if the accused is not in custody the officer may take security and the Magistrate must accept it. The officer must send necessary weapons or articles to the Magistrate, require complainant and relevant witnesses to execute bonds to appear and prosecute or give evidence, deliver a copy of the bond to an executant, and forward the original with his report.
