State Governments Must Appoint Assistant Public Prosecutors in Each District Under Section 19 of 2023 Code
Section 19 of the Bharatiya Nagarik Suraksha Sanhita, 2023, mandates the appointment of Assistant Public Prosecutors by the State Government in each district to handle prosecutions in Magistrates' Courts. The Central Government also has the authority to appoint Assistant Public Prosecutors for specific cases. If no Assistant Public Prosecutor is available, the District Magistrate can appoint another person with a fourteen-day notice to the State Government, provided that the appointee is not a police officer involved in the investigation or below the rank of Inspector.
