Section 187: Procedures for Detention Beyond 24 Hours; Magistrate's Role, Time Limits, and Special Provisions for Minors
Section 187 of the Bharatiya Nagarik Suraksha Sanhita, 2023 outlines procedures when an investigation cannot be completed within 24 hours. If an accused is detained and the investigation is incomplete, the police must send case details to a Magistrate, who can authorize detention up to 15 days, extendable to 60 or 90 days depending on the offense. Detention beyond 15 days requires sufficient grounds. Accused must be presented to the Magistrate, and detention cannot exceed specified periods without bail. Special provisions apply for minors and when a Magistrate is unavailable. Investigations exceeding six months may be halted unless justified.
