Evidence in presence of accused: trial evidence must be recorded with accused or advocate present, protecting minor sexual offence witnesses. Section 308 requires that evidence in trial or other proceedings be taken in the presence of the accused or, where personal attendance is dispensed with, in the presence of the accused's advocate, including by audio video means at a State-designated place; the Court may prevent confrontation of a woman below eighteen alleged to have been subjected to sexual offences while ensuring the right of cross-examination; 'accused' includes persons under Chapter IX proceedings.
