<h1>Section 146: Modify Maintenance Orders for Changed Circumstances or Civil Court Decisions, Cancel for Remarriage or Voluntary Relinquishment.</h1> Section 146 of the Bharatiya Nagarik Suraksha Sanhita, 2023, addresses alterations in maintenance allowances. It allows a Magistrate to modify maintenance orders under Section 144 based on changes in circumstances or decisions from a competent Civil Court. If a divorced woman remarries or receives a settlement under customary or personal law, the maintenance order may be canceled. Additionally, if a woman voluntarily relinquishes her maintenance rights post-divorce, the order is canceled. Civil Courts must consider previous maintenance payments when issuing decrees for recovery of maintenance or dowry.
