Successor judge may act on evidence recorded by predecessor, with power to re summon witnesses for further examination. A succeeding Judge or Magistrate may act on evidence wholly or partly recorded by a predecessor and may re summon any witness whose evidence has been recorded for further examination, cross examination or re examination in the interests of justice; after such further examination the witness shall be discharged. A transfer of a case is deemed to effect such succession. The section excludes summary trials and cases where proceedings are stayed or submitted to a superior Magistrate.
