Court Can Transfer Section 384 Cases to Magistrate for Serious Penalties Exceeding 200 Fine or Imprisonment.
If a court determines that a case involving offenses under section 384 should not be resolved through the provisions of that section, particularly if imprisonment or a fine exceeding two hundred rupees is warranted, the court may forward the case to a Magistrate with jurisdiction. The court must record the facts and the accused's statement before doing so. The accused may be required to provide security for appearance before the Magistrate, or if security is insufficient, they may be sent in custody. The Magistrate will then handle the case as if it originated from a police report.
