Section 222: Court Can Order Accuser to Compensate Acquitted Accused, Trials May Be In Camera, Appeals Allowed.
A Court of Session handling cases under sub-section (2) of section 222 follows warrant-case procedures, excluding police reports. The alleged victim must testify unless the court decides otherwise. Trials may be held in camera if requested. If the accused are acquitted without reasonable cause for accusation, the court can order the accuser to pay compensation, capped at five thousand rupees, to the accused. This compensation is recoverable as a fine and does not exempt the accuser from further liability. The accuser can appeal the compensation order to the High Court, and compensation is withheld until the appeal period ends or is resolved.
