<h1>Magistrates' Role in Handling Arrested Individuals: Procedures for Custody, Bail, and Security Under Section 83, 2023</h1> Section 83 of the Bharatiya Nagarik Suraksha Sanhita, 2023, outlines the procedure for a Magistrate when an arrested individual is brought before them. If the arrested person matches the individual intended by the court-issued warrant, the Magistrate, District Superintendent, or Commissioner of Police must direct their custody transfer to the relevant court. If the offense is bailable and the individual can provide a satisfactory bail bond, it should be taken and forwarded to the issuing court. For non-bailable offenses, the Chief Judicial Magistrate or Sessions Judge may release the individual on bail, subject to certain provisions. This section also allows police officers to take security as per section 73.
