Section 391: Judges Can't Try Contempt Offences Committed in Their Presence; Exceptions in Sections 383-389
Section 391 of the Bharatiya Nagarik Suraksha Sanhita, 2023, stipulates that no Judge of a Criminal Court, other than a High Court Judge, or a Magistrate is permitted to try any person for offences outlined in section 215 if those offences are committed directly before them, in contempt of their authority, or brought to their attention during judicial proceedings. Exceptions to this rule are provided in sections 383, 384, 388, and 389. This provision aims to maintain impartiality and prevent conflicts of interest in the administration of justice.
