Power to order inquiry: higher courts may direct magistrates to conduct further inquiries into dismissed complaints or discharged accused. High courts and Sessions Judges may direct the Chief Judicial Magistrate or a subordinate magistrate to make further inquiry into complaints dismissed at the magistrate level or into the case of a discharged person; however, no court may order such an inquiry into a discharged person's case unless that person has been given an opportunity to show cause against the direction.
