Section 489: Sureties Can Apply to Discharge Bail Bonds Anytime; Magistrate May Require New Sureties or Jail Commitment.
Section 489 of the Bharatiya Nagarik Suraksha Sanhita, 2023, addresses the discharge of sureties for individuals released on bail. Sureties can apply to a Magistrate at any time to discharge the bond, either entirely or partially. Upon receiving such an application, the Magistrate issues an arrest warrant to bring the individual before the court. If the person appears or surrenders voluntarily, the Magistrate may discharge the bond and require the individual to find new sureties. Failure to secure new sureties may result in the individual being committed to jail.
