of <h1>High Court Can Transfer Criminal Cases for Fair Trials or Convenience Under Section 447 of Bharatiya Nagarik Suraksha Sanhita 2023.</h1> Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, grants the High Court the authority to transfer criminal cases and appeals. The High Court may transfer cases when a fair trial is unlikely, a complex legal question arises, or for the convenience of parties or witnesses. Transfers can be made to courts of equal or superior jurisdiction, or the High Court may try the case itself. Applications for transfer must be supported by affidavits, and notice must be given to the Public Prosecutor. The High Court can stay proceedings during the application process and may impose compensation for frivolous applications.
