Victims of crime can receive compensation from funds established by State and Central Governments under Bharatiya Nyaya Sanhita, 2023.
Every State Government, in coordination with the Central Government, must establish a scheme to provide compensation funds to victims or their dependents who have suffered due to crime and need rehabilitation. The District or State Legal Service Authority determines the compensation amount when recommended by the Court. If the trial Court finds the compensation inadequate or the case ends in acquittal, it can recommend further compensation. Victims can apply for compensation if the offender is unidentified. The Legal Services Authority must complete inquiries within two months and may provide immediate aid. Compensation is additional to fines under specified sections of the Bharatiya Nyaya Sanhita, 2023.
