<h1>Magistrates Can Delay Process Under Bharatiya Nagarik Suraksha Sanhita, 2023, Section 225 for Jurisdictional and Inquiry Reasons.</h1> Section 225 of the Bharatiya Nagarik Suraksha Sanhita, 2023, allows a Magistrate to postpone issuing a process upon receiving a complaint of an offense. The Magistrate may conduct an inquiry or direct an investigation to assess if there are sufficient grounds to proceed, especially if the accused resides outside the Magistrate's jurisdiction. However, investigations are not directed if the offense is exclusively triable by the Court of Session or if the complaint is not court-initiated without witness examination under oath. Investigators, if not police officers, have similar powers to police, excluding arrest without a warrant.
