Affidavit Validity for Summons Served Outside Jurisdiction or Electronically under Sections 64-71: Presumed Correct Unless Challenged.
When a court summons is served outside its local jurisdiction or the serving officer is absent at the hearing, an affidavit made before a Magistrate, along with a duplicate of the summons endorsed by the recipient, is admissible as evidence. The statements in the affidavit are presumed correct unless proven otherwise. This affidavit can be attached to the summons and returned to the court. Summons served electronically under sections 64 to 71 are considered duly served, with a copy attested and retained as proof of service.
