Magistrate Must Provide Accused with Free Document Copies in Non-Police Report Cases Under Sections 223, 225, 180, 183
In cases not initiated by a police report and deemed exclusively triable by the Court of Session, the Magistrate must promptly provide the accused with free copies of certain documents. These include statements recorded under sections 223 or 225, any statements or confessions under sections 180 or 183, and documents the prosecution intends to rely on. If a document is too voluminous, the Magistrate may allow inspection instead of providing a copy. Additionally, documents supplied electronically are considered duly furnished.
