<h1>Magistrate must examine complainant and witnesses under oath unless complaint is by public servant or transferred.</h1> A Magistrate with jurisdiction must examine the complainant and any present witnesses under oath when taking cognizance of an offence on complaint, with the examination recorded in writing and signed by all parties involved. However, if the complaint is written by a public servant or a court, or if the case is transferred to another Magistrate, such examination may not be necessary. Complaints against public servants require the accused to be heard and a report from a superior officer before cognizance is taken. If a case is transferred after examination, re-examination by the new Magistrate is not required.
