New Law Ensures Care for Accused with Mental Health Issues: Bail Options and Facility Placement Explained under Section 369.
Section 369 of the Bharatiya Nagarik Suraksha Sanhita, 2023, addresses the handling of accused persons deemed incapable of defending themselves due to unsoundness of mind or intellectual disability. If such a person does not require in-patient treatment, they may be released on bail, provided a friend or relative ensures regular psychiatric care and safety. If bail is not feasible or an undertaking is absent, the accused is placed in a facility for psychiatric treatment, with the State Government informed. The Magistrate or Court assesses the nature of the act and mental condition to decide on release or transfer to a residential facility for care and education.
