Release of mentally incapacitated accused: bail or placement depending on treatment availability and risk, with mandated safeguards. Persons found incapable of entering defence because of unsoundness of mind or intellectual disability shall be released on bail when inpatient treatment is not required and a relative or friend undertakes regular out patient psychiatric treatment and prevention of harm. If bail cannot be granted or no suitable undertaking exists, the accused shall be kept where regular psychiatric treatment can be provided, reported to the State Government, and any detention in a public mental health establishment must follow applicable mental health rules. Courts must further determine whether discharge on sufficient security is appropriate or whether transfer to a residential care and training facility is required.
