<h1>Appellate Court Can Suspend Sentences Pending Appeal Under Section 430; Bail Possible with Conditions and Prosecutor's Input.</h1> Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023, allows an Appellate Court to suspend the execution of a sentence pending appeal and release the appellant on bail or bond, provided reasons are recorded in writing. For serious offenses, such as those punishable by death or long imprisonment, the Public Prosecutor must be given an opportunity to oppose the release. The High Court can also exercise this power for appeals to subordinate courts. If a convicted person intends to appeal, the court may release them on bail unless there are special reasons not to, and the imprisonment sentence is suspended during this period. Time on bail is excluded from the final sentence calculation.
