Summary trial for false evidence: court may summarily try and punish witnesses found to have knowingly fabricated or given false testimony. Summary procedure allows a Court of Session or a first-class Magistrate, when expressing at judgment that a witness knowingly or wilfully gave or fabricated evidence, to take cognizance and summarily try that witness after a reasonable opportunity to show cause, following summary-trial procedure as nearly as practicable; the court may impose imprisonment for a limited term, a fine, or both. The section preserves the alternative to make a complaint under the separate offence provision and requires staying summary proceedings if an appeal or revision against the judgment or order has been filed, with further trial proceedings to abide by the appellate outcome.
