Section 399: Access Company Documents Online, Obtain Certified Copies, and Use in Court Without Proving Registrar's Role.
Section 399 of the Companies Act, 2013, allows individuals to inspect documents maintained by the Registrar electronically, subject to prescribed fees. Certified copies of incorporation certificates or other documents can also be obtained upon payment. Access to documents related to a prospectus is limited to fourteen days post-publication, requiring Central Government permission otherwise. Courts or Tribunals must grant leave for compelling document production from the Registrar. Certified copies of registered documents are admissible in legal proceedings with the same validity as originals, without needing to prove the Registrar's official position.
