<h1>Company fraud offences u/s 435(1): only jurisdictional Special Court can try, handle remand, and take cognizance.</h1> All offences specified under section 435(1) are triable exclusively by the Special Court having territorial jurisdiction based on the company's registered office, as allocated where multiple Special Courts exist, thereby displacing ordinary criminal court jurisdiction. Where an accused or suspect is forwarded to a Magistrate under section 167 of the Code of Criminal Procedure, the Magistrate may authorise detention up to 15 days (Judicial Magistrate) or 7 days (Executive Magistrate) and must forward the person to the jurisdictional Special Court if continued detention is unnecessary; the Special Court then exercises section 167 remand powers. The Special Court may take cognizance on a police report or complaint without committal, may jointly try connected non-Companies Act offences, and may summarily try offences punishable up to three years, subject to a maximum one-year imprisonment in summary conviction or conversion to regular trial.
