Omission of Section 268 Companies Act ends exclusive jurisdiction bar, lifting restrictions on civil suits and injunctions
Section 268 of the Companies Act, 2013, which previously imposed a bar on the jurisdiction of civil courts and other authorities over matters assigned to the Tribunal or Appellate Tribunal under the Chapter on revival and rehabilitation of sick companies, has been omitted by the Insolvency and Bankruptcy Code, 2016 with effect from 15-11-2016. Earlier, it prohibited appeals to any court or authority and barred injunctions against actions taken or proposed under the Chapter, thereby conferring exclusive jurisdiction on the designated tribunals.
