Section 276: Grounds and process for removal of liquidator, transfer of duties, and recovery for loss caused
Section 276 of the Companies Act, 2013 empowers the Tribunal to remove a provisional or company liquidator for recorded reasons, including misconduct, fraud, misfeasance, professional incompetence, lack of due care and diligence, inability to act, conflict of interest, or lack of independence. On death, resignation, or removal, the Tribunal may transfer the liquidator's work to another liquidator with reasons recorded in writing. If the Tribunal finds the liquidator caused loss or damage to the company through fraud, misfeasance, or negligence, it may order recovery of such loss and issue further appropriate orders. A reasonable opportunity of being heard must be given before any order is passed.
