<h1>Company names too similar to existing companies or registered trademarks, triggering government-ordered renaming and enforced new names</h1> Where a company is registered on incorporation or on change of name with a name identical with, or too nearly resembling, an existing company name, the Central Government may direct the company to change its name by ordinary resolution within three months, and the company must comply. Where a registered trade mark proprietor applies within three years that the company name is identical with, or too nearly resembles, its registered trade mark, the Central Government may similarly direct a name change within three months, requiring compliance. Upon changing its name under such direction, the company must notify the Registrar within fifteen days with the Central Government's order, enabling consequential amendments to the certificate of incorporation and memorandum. If the company defaults, the Central Government may allot a new name, which the Registrar must register and certify for mandatory use thereafter.
