Appeals against tribunal orders: consent orders barred, 45-day filing deadline, and delay condonable only up to 45 days
Any person aggrieved by an order of the Tribunal may appeal to the Appellate Tribunal, but no appeal lies against an order made by the Tribunal with the consent of parties, thereby rendering consent orders non-appealable. An appeal must be filed within 45 days from the date a copy of the Tribunal's order is made available to the aggrieved person, in the prescribed form and with prescribed fees; the Appellate Tribunal may condone delay for sufficient cause, but only up to a further 45 days, thereby limiting extension of time. Upon receipt of an appeal, the Appellate Tribunal must give the parties a reasonable opportunity of being heard and may confirm, modify, or set aside the impugned order, and must transmit a copy of its order to the Tribunal and the parties, thereby ensuring communication and implementation of the appellate decision.
