Non-cooperation with Company Liquidator now leads to Tribunal compliance orders, replacing earlier criminal penalties for obstruction
Promoters, directors, officers and employees, whether currently or formerly associated with a company, are obligated to provide full cooperation to the Company Liquidator in performing liquidation functions and duties. If any such person fails or refuses to assist or cooperate as required, the Company Liquidator may apply to the Tribunal for appropriate directions. Upon such application, the Tribunal must order the concerned person to comply with the instructions of the Company Liquidator and to cooperate in the discharge of the Liquidator's statutory functions and duties, replacing the earlier regime of criminal penalties for non-cooperation.
