Removal for proved misbehaviour or incapacity requires a reference to a Supreme Court Judge nominated by the Chief Justice for inquiry, after which the Central Government may order removal on receipt of the report; the Government may suspend the office holder, with the Chief Justice's concurrence, pending the inquiry, and must consult the Supreme Court in framing inquiry procedure rules.
