Voluntary winding up costs are payable from company assets in priority to other claims, subject to secured creditors' rights. Section 323 was omitted. Previously it provided that all costs, charges and expenses properly incurred in a voluntary winding up, including the liquidator's fee, were payable out of the company's assets in priority to other claims, subject to the rights of secured creditors.
