<h1>Appointment process for NCLT and NCLAT members: Chief Justice consultation and selection committee recommendations upheld, including tie-break rules.</h1> Prescribes the appointment and selection process for Members of the National Company Law Tribunal and the National Company Law Appellate Tribunal. The President of the Tribunal and the Chairperson and Judicial Members of the Appellate Tribunal must be appointed after consultation with the Chief Justice of India, conditioning such appointments on that consultation. Other Tribunal Members and Technical Members of the Appellate Tribunal must be appointed on the recommendation of a Selection Committee comprising the Chief Justice of India or nominee (Chairperson), a senior Supreme Court Judge or Chief Justice of a High Court, and the Secretaries of Corporate Affairs and Law and Justice; the Chairperson has a casting vote in case of equality, and the Committee sets its own procedure, thereby governing recommendation-making and tie-breaking. The Corporate Affairs Secretary convenes the Committee, and appointments are protected from invalidity due to vacancies or defects in the Committee's constitution.
