Once a winding-up petition is presented but before a winding-up order is made, and where the application is made by a creditor, the court may stay or restrain legal actions not only against the company but also against its contributories. These powers apply under the Companies Act, 2013 and, where relevant, under the Insolvency and Bankruptcy Code, 2016, ensuring coordinated control over proceedings affecting both the company and those liable to contribute to its assets.
