<h1>Company investigations under Chapter XIV continue despite Section 241 petitions, voluntary winding up, or ongoing winding up proceedings</h1> Investigation under Chapter XIV of the Companies Act, 2013 may be initiated, continued, and not suspended merely because an application under section 241 is filed, the company has resolved for voluntary winding up, or winding up proceedings are pending before the Tribunal. If the Tribunal passes a winding up order in such proceedings, the inspector must inform the Tribunal of the ongoing investigation, and the Tribunal may issue appropriate directions. The winding up order does not relieve any director or employee from the duty to participate in the investigation or from liability arising from the inspector's findings.
