<h1>Tribunal procedure under Companies Act/IBC: not bound by CPC, follows natural justice, wields civil-court powers and enforceable orders.</h1> The Tribunal and the Appellate Tribunal are not bound by the Code of Civil Procedure, 1908 when disposing of proceedings or appeals, but must follow principles of natural justice and may regulate their own procedure, subject to the Companies Act, 2013 and, where applicable, the Insolvency and Bankruptcy Code, 2016 and rules thereunder. For discharging functions under these statutes, they are vested with specified civil-court powers, including summoning and examining persons on oath, compelling discovery and production of documents, receiving affidavit evidence, requisitioning public records (subject to Evidence Act limits), issuing commissions, dismissing matters for default or ex parte, and setting aside such orders. Their orders are enforceable as court decrees and may be transmitted for execution to the competent local court; proceedings are deemed judicial proceedings and the Tribunals are deemed civil courts for specified criminal procedure purposes.
