Section 378J: Converting Inter-State Co-operative Societies into Producer Companies with New Name and Governance Rules
Section 378J permits an inter-State co-operative society, whose objects extend beyond one State and relate to producer activities under section 378B, to apply for registration as a Producer Company. The application must include a special resolution passed by at least two-thirds of its members, details of directors, chief executive, and members, a statement of eligible objects, and a directors' declaration of accuracy. Upon registration, 'Producer Company Limited' must be added to its name, it is incorporated as a Producer Company within thirty days, and is thereafter governed exclusively by this Chapter. Prior acts remain valid, no claims arise due to conversion, and the earlier Registrar must delete the co-operative from its register.
