Companies Act mediation referrals let parties or tribunals send disputes to mediation and incorporate settlements into orders. Parties to proceedings before the Central Government, Tribunal or Appellate Tribunal may apply for referral to mediation, and those authorities may also refer matters suo motu; mediation is to be conducted under the Mediation Act, 2023. The mediator or mediation service provider must file the mediated settlement agreement with the referring authority, which shall pass an order or judgment making the mediated settlement agreement part of the record. Mediator fees are to be prescribed.
