of <h1>Mediation and Conciliation Panel for company disputes u/s 442 during ongoing proceedings, with 3-month recommendations process</h1> Section 442 mandates the constitution and maintenance of a Mediation and Conciliation Panel of prescribed experts for mediating disputes between parties during the pendency of proceedings under the Companies Act, 2013 before the Central Government, the Tribunal, or the Appellate Tribunal. Any party may apply, in the prescribed form and with prescribed fees, for referral of a matter to the Panel, and the concerned forum must appoint one or more panel experts; the forum may also refer a matter suo motu to such experts as it deems fit, enabling structured alternative dispute resolution within ongoing proceedings. Experts' fees and terms are prescribed. The Panel must follow prescribed procedure, dispose of referred matters within three months, and forward recommendations, against which parties may file objections to the concerned forum.
