of <h1>Voluntary winding up commencement u/s 308 Companies Act now superseded by Insolvency and Bankruptcy Code framework</h1> Section 308 of the Companies Act, 2013, previously governed the commencement of voluntary winding up, providing that such winding up was deemed to commence on the date the resolution for voluntary winding up was passed under section 304. This provision has been omitted by Section 255 read with the Eleventh Schedule of the Insolvency and Bankruptcy Code, 2016, with effect from 15-11-2016, as notified by the specified government notification. As a result, the earlier statutory mechanism for determining the commencement date of voluntary winding up under the Companies Act, 2013 has been superseded and is now governed by the insolvency framework under the Insolvency and Bankruptcy Code.
